Victory over PUERTO CALMA. Las Palmas Court of Appeal, room 4, judgement nº 149/2018.

On this occasion, Room 4 of the Court of Appeals upheld the sentence issued by Court No. 4 of San Bartolomé that had already declared the contract null and void, in this case condemning Puerto Calma Marketing and Vista Amadores to pay to my clients the sum of 24,439.42 euros.

As can be seen in page number two, the Courts did the deduction based in the Supreme Court criteria that compensate defendants with a deduction in consideration to the "used years". In this case the contract was signed in 2002, for an amount of 33,943.63 euros, being the claim submitted in 2015, thus my clients used the weeks for 13 years so 9,504.21 euros should be deducted from the total money to return.

The defendants were condemned to pay legal costs for the appeal but not for the first instance.
